You Could Face A Jail Or Prison Sentence

Child molestation, or lewd acts with a child under 14, encompasses numerous acts; see California Penal Code 288. The statute says, “Any person who willfully and lewdly commits any lewd or lascivious act, upon the body, or any part or member thereof, of a child who is under the age of 14 years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child is guilty.”

The penalties for child molestation offenses vary depending on the specific circumstances of the case. The age of the child is just one factor. There is also whether the alleged abuser used force or threats, and whether the child suffered bodily injury.

In general, people convicted of these offenses may face up to one year in county jail to up to 10 years in state prison. A conviction also means the defendant must register as a sex offender for life.
